- You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872.
- If you use the Services for a business or another person, you confirm you are authorised to bind that entity or person to these Terms.
04The Services
Through the Platform we facilitate services which may include income-tax return preparation and filing, GST registration and returns, TDS filings, company and LLP incorporation and ROC/MCA compliances, accounting and bookkeeping support, and related advisory. Some Services are delivered with the assistance of independent chartered accountants, company secretaries or tax practitioners.
What efiletax is
We provide tools and assistance to help you meet your compliance obligations. Except where we expressly agree in writing to a specific professional engagement, we act as a technology provider and facilitator. Responsibility for the correctness, completeness and timeliness of any filing rests with you as the taxpayer or entity concerned.
05Your account
- Give accurate, current and complete information when you register, and keep it up to date.
- Keep your login credentials confidential. You are responsible for all activity under your account.
- Tell us immediately at support@efiletax.in if you notice unauthorised use or a security problem.
06Your responsibilities
- Provide true, accurate and complete information, documents and figures, and review every draft before you authorise a filing.
- Make sure you have the right to share any third-party information you give us.
- Comply with all applicable tax, corporate and other laws. Using the Services does not relieve you of your own legal obligations.
- Keep copies of your filings and supporting records for as long as the law requires.
07Authorisation to act on your behalf
When you ask us to prepare, submit, e-verify or retrieve records from government portals — including the Income Tax Department, GSTN, TRACES and MCA — you authorise us and the professionals we engage to access those portals and act on your behalf, using the credentials or consent you provide, solely to deliver the Services.
You remain responsible for the accuracy of the underlying information, and for personally e-verifying returns where the law requires you to do so.
08Fees, payments and taxes
- Fees are shown on the Platform or communicated to you before you place an order, and are payable in advance unless we state otherwise.
- Fees are exclusive of applicable taxes, including GST, which are charged in addition.
- Government fees, statutory charges and third-party costs — such as ROC fees, stamp duty, DSC costs and portal charges — are separate from our service fee and are non-refundable once incurred.
- Payments are processed through RBI-authorised payment gateways. We do not store your full card or banking credentials.
- Refunds, where they apply, are governed by our Refund & Cancellation Policy.
Invoices are issued by Starkbros Consultancy Private Limited under GSTIN 33ABDCS6595F1Z4 unless the place of supply requires otherwise.
09Government portals and third parties
The Services depend on government portals and third-party systems outside our control. We are not responsible for downtime, errors, rejections, changes in law or procedure, or delays caused by them. Your use of those portals is also subject to their own terms.
10No professional-advice guarantee
Important
Information and general guidance on the Platform is provided for convenience and is not personalised legal, tax, accounting or investment advice. Tax outcomes depend on your specific facts and on law that changes. We do not guarantee any particular refund, assessment result, approval or acceptance by any authority. Obtain independent professional advice for decisions specific to your situation.
11Acceptable use
You agree not to:
- Use the Services for any unlawful, fraudulent or misleading purpose, including filing false information or evading tax.
- Upload malicious code, attempt unauthorised access, or disrupt the Platform's security or availability.
- Copy, scrape, reverse-engineer, resell or commercially exploit the Platform or its content without our written permission.
- Impersonate any person, or misuse another user's account or data.
12Intellectual property
The Platform and all associated content, software, trademarks, logos (including "efiletax"), designs and materials are owned by or licensed to Starkbros and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for its intended purpose.
You keep ownership of the documents and data you upload, and grant us a licence to use them only to provide the Services.
13Confidentiality and data protection
We treat your information as confidential and process personal data in line with our Privacy Policy, the Digital Personal Data Protection Act, 2023 and the DPDP Rules, 2025.
14Communications
By using the Services you agree to receive service-related communications — including deadline reminders and filing status — by email, SMS, WhatsApp or phone. You can opt out of promotional messages at any time; transactional and service messages will continue where necessary.
15Disclaimers
The Services are provided on an "as is" and "as available" basis. To the maximum extent the law permits, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that any filing will be accepted by the relevant authority.
16Limitation of liability
To the maximum extent the law permits, Starkbros and its directors, officers, employees and partners are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill, interest, penalty or tax liability arising from information you provided or from your own acts or omissions.
Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the total fees you paid us for the specific Service giving rise to the claim in the three (3) months before the event. Nothing here limits liability that cannot be excluded under applicable law.
17Indemnity
You agree to indemnify and hold harmless Starkbros and its personnel against claims, losses, liabilities, penalties, costs and expenses (including legal fees) arising from your breach of these Terms, your violation of any law, or the inaccuracy of information or documents you provided.
18Suspension and termination
You may stop using the Services at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, provide false information, misuse the Platform, or where the law requires it.
Provisions that by their nature should survive termination — fees due, intellectual property, disclaimers, limitation of liability and indemnity — will survive.
19Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, government or portal outages, changes in law, network failures, strikes or pandemics.
20Governing law and disputes
These Terms are governed by the laws of India. Subject to the arbitration provision below, the courts at Chennai, Tamil Nadu have exclusive jurisdiction.
Any dispute will first be attempted to be resolved amicably. Failing that, it will be referred to arbitration by a sole arbitrator appointed by Starkbros under the Arbitration and Conciliation Act, 1996, seated at Chennai and conducted in English. Either party may still seek urgent interim relief from a competent court.
